Agricultural Law

For more than 40 years, we have assisted family farming entities, family farms, processors, and other participants in the agri-business sector with a variety of their legal needs.

We are familiar with the supply management quota systems, mostly in the ‘feather’ industries, and we have done extensive work in this area, including presentations to Supply Management Boards and appeals to the Farm Products Appeal Tribunal, Farm Marketing Commissions and Judicial Reviews.

We have also represented agri-businesses in a number of hearings before the Canadian Agricultural Review Tribunal, and the Competition Tribunal of Canada, the Federal Court, and the Federal Court of Appeal, with respect to issues involving supply managed farm products and agri-business for various participants in this sector. We have conducted mediations on behalf of farmers to resist municipal encroachment under Ontario’s Farming and Food Protection Act.

We have assisted individuals and families in the farming industry with succession planning, family trusts, and estate-planning issues, as well as inter-generational roll-over of family farm enterprises, with tax deferral strategies.  We usually work with the accounting advisors to these families to implement these programs, and to ensure that taxation is minimized or deferred.

We have assisted farming families and families involved in the agri-business and food-processing sector with their corporate needs and with sales of their enterprises when the time is appropriate to sell.

We try to keep our fees for these services down to a reasonable and competitive level.  Our goal is to provide optimum service for our clients, based on extensive experience.

Ron Folkes is from a family farm background. He has worked with families in farming and the food-processing industry, who have developed their industries from start-up operations to national-brand corporations.  We understand our clients’ perspective on legal issues and the importance of these matters being properly handled.
